Changes to IR35 planned in the mini budget last month by the previous Chancellor Kwasi Kwarteng have been cancelled by the new Chancellor in his emergency statement.
He said in his statement this morning (17 October 2022) that the reforms would not be going ahead.
“The government has today decided to make further changes to the mini budget,” the Chancellor said. “We will reverse almost all the tax measures announced in the growth plan three weeks ago that have not started Parliamentary process.
“We will no longer be proceeding with the reversal of off-payroll working reforms [IR35] introduced in 2017 and 2021.”
So once again the responsibility for setting employment status and ensuring the correct amount of tax and National Insurance will revert to the end client if they are a public sector organisation or mid to large private sector organisation.
If you as the worker are deemed to be inside IR35 the customer organisation will be responsible for dealing with the relevant tax and National Insurance contributions.
